Denton and North Dallas Areas Hit by Massive Hail Storm

by Martin Arguello

On April 4, 2014, severe storms and tornados hit the Dallas and Denton, Texas areas, including Frisco and Allen, Texas.

I have personally worked hail storm claims in the North Dallas area before, both as a public adjuster, as an insurance adjuster, and as an insurance bad faith attorney.

In my experience in Garland and Richardson working as a public adjuster, I frequently saw insurance companies including State Farm, Farmers, Foremost, Allstate, Germania, and Farm Bureau unfairly denying and underpaying claims.  In particular, I witnessed these companies trying to low ball homeowners by paying for roof repairs instead of roof replacements, denying that fences can be damaged by hail, denying damage to decks, window screens, window beading, and paint.  Fortunately even then, as a public adjuster, I had Andrew Hope, my partner, who could back me up as an attorney.  While there is a lot a public adjuster or contractor can do to help a homeowner with a hail or wind damage claim, ultimately only an attorney can hold the insurance company accountable in a court of law.  Thus, as attorneys, we are able to achieve much better results for our clients than contractors or public adjusters.  Furthermore, unlike contractors, we’re not interested in just getting your roof paid.  We evaluate and recover for ALL covered damages, including personal property—things like patio furniture, flower pots, yard toys and ornaments.  You see, our goal is to get you every penny you’re entitled to under your policy—not just enough to do some repairs and make a profit.

In the coming weeks, thousands of covered hail and wind damage claims will be underpaid and denied, often in bad faith and in breach of the Texas Insurance Code.  If you or someone you know believes you have been unfairly denied or are being low-balled by your insurance company, call us today.  We handle hail and wind first party property insurance cases on a contingent fee basis—that means you’re not responsible for fees or costs except to the extent we make a recovery for you.
