Workers’ Compensation Attorneys

A workers hard hat and other equipment.

In a study recently released by the U.S Bureau of Labor Statistics, it was noted that more than 2.9 MILLION non-fatal workplace illnesses and injuries were reported in 2011 alone – with the rate of employee injuries increasing noticeably in the agricultural, forestry and fishing industries. However with these statistics in mind, it’s important to note that despite workers’ compensation laws and regulations being created to help workers and provide them with a financial safety net in the event of an injury, due to the many fraudulent claims that are filed against the system, quite often legitimate applicants are refused benefits on the grounds that they are not eligible to receive them. If you or someone you love has been injured on the job or at their workplace and have been denied workers’ compensation benefits, we can help.

High Risk Occupations

While almost any area in the workplace can become the scene of a workplace injury, there are some industries that are more hazardous than others. Some of these can include (but are not limited to):

  • Agricultural – farmer, livestock handler
  • Manufacturing – process worker, steel mill worker
  • Construction – laborer, electrician, welder, pipe fitter
  • Transportation / logistics – truck driver, storemen
  • Medical – nurse, assisted living care giver, ER staff
  • Commercial Fishing – crab / lobster fishermen

…. Just to name a few. It’s also worth considering that a worker may also have grounds to file a claim for workers’ compensation if they acquire a disease while on that job. Some examples of this may be a medical staff member that contracts a dangerous disease or an air conditioning technician that contracts Legionnaires Disease while working on the cooling tower of an office building.

Common Workplace Injuries

There can be many different types of injuries that can occur in the workplace simply due to the diversity of the environments that employees work in. However, the most common types of injuries include:

  • Lower back injuries (herniated discs, strained muscles)
  • Slip and fall injuries
  • Chemical burns and skin reactions
  • Broken bones
  • Repetitive Strain Injury (RSI)
  • Concussion / Head injuries
  • Nerve damage
  • Heart attacks
  • Eye injuries
  • Burns
  • Lacerations
  • Dislocated joints

…. Amongst many others. In most cases, many of these injuries are caused by faulty equipment, carelessness of co-workers or simply due to workplace safety regulations not being followed correctly.

Benefits Available to Injured Workers

In an effort to address the different types of injuries that a worker can obtain at the workplace, the workers’ compensation system offers a variety of benefits to cater to these situations. The six primary types include: Permanent – as the name implies, permanent benefits are paid and provided to workers that have sustained an injury – or injuries – that prevent them from returning to work in any capacity. Permanent Impairment – these benefits are often provided to a worker that has suffered a serious injury that may include loss of eyesight, the loss of a limb or similar. In most cases, permanent impairment benefits are awarded to those that have sustained an injury that impedes their ability to perform their primary work function. Temporary Total – in the event that a worker sustains an injury that prevents them from returning to work for a limited period of time, temporary total benefits are often provided to that worker. Temporary Partial – these benefits are often provided to workers that can have ability to return to work in a limited capacity while they are recovering from an injury sustained in the workplace. Supplemental – an injury victim may be eligible to receive supplemental benefits if the worker is earning less than their pre-injury wage, or if they are determined to have an injury rating of 20% or more. Death – in the event of a worker being killed due to a workplace accident, the family or dependents of that worker may be eligible to receive death compensation payments. However, it’s important to note that there are strict time limits imposed on applying for these types of benefits.
